The Dutch law states that a physician may perform euthanasia according to a written advance euthanasia directive when a patient is incompetent as long as all legal criteria of due care are met. The paradox of phase transitions raises the problem of how to reconcile the fact that we see phase transitions happen in concrete, finite systems around us, with the fact that our best theories—i.e. statistical-mechanical theories of phase transitions—tell us that phase transitions occur only in infinite systems. In this paper we aim to clarify to which extent this paradox is relative to the mathematical framework which is used in these theories, i.e. classical mathematics. To this aim, we will explore the (...) philosophical consequences of adopting constructive instead of classical mathematics in a statistical-mechanical theory of phase transitions. It will be shown that constructive mathematics forces certain ‘de-idealizations’ of such theories: talk of actually infinite systems is meaningless, there are no discontinuous functions, and—in a sense which will be clarified—constructive real numbers reflect our imperfect methods of determining the values of physical quantities. As such, so it will be argued, constructive mathematics offers a means to gain insight in the idealizations introduced in classical theories and the philosophical issues surrounding them. (shrink)

Relatives were defined as caring or living closely to a patient. Women, relatives with a higher education and partners experienced more impact of the affiliate stigma on mental well-being than man, relatives with a lower education and relatives with another relationship to the person with dementia. The duration of dementia and the age of the caregiver had a clear significant effect on affiliate stigma.ConclusionThis study revealed that caregiver related features are predicting the presence of an affiliate stigma. Interventions to prevent or reduce the impact of this stigma might focus on these groups. Education about dementia and the impact on patients, relatives and the broader social context might alter the affiliate stigma surrounding dementia. (shrink)

Emotions are traditionally considered to be brief states that last for seconds or a few minutes at most. However, due to pioneering theoretical work of Frijda and recent empirical studies, it has become clear that the duration of emotions is actually highly variable with durations ranging from a few seconds to several hours, or even longer. We review research on determinants of emotion duration. Three classes of determinants are identified: features related to the emotion-eliciting event, emotion itself, and emotion-experiencing person. The Netherlands is one of the few countries where euthanasia is legal under strict conditions. This study investigates whether Dutch newspaper articles use the term ‘euthanasia’ according to the legal definition and determines what arguments for and against euthanasia they contain. We did an electronic search of seven Dutch national newspapers between January 2009 and May 2010 and conducted a content analysis. Of the 284 articles containing the term ‘euthanasia’, 24% referred to practices outside the scope of the law, mostly (...) relating to the forgoing of life-prolonging treatments and assistance in suicide by others than physicians. Of the articles with euthanasia as the main topic, 36% described euthanasia in the context of a terminally ill patient, 24% for older persons, 16% for persons with dementia, and 9% for persons with a psychiatric disorder. The most frequent arguments for euthanasia included the importance of self-determination and the fact that euthanasia contributes to a good death. The most frequent arguments opposing euthanasia were that suffering should instead be alleviated by better care, that providing euthanasia can be disturbing, and that society should protect the vulnerable. Of the newspaper articles, 24% uses the term ‘euthanasia’ for practices that are outside the scope of the euthanasia law. Typically, the more unusual cases are discussed. This might lead to misunderstandings between citizens and physicians. Despite the Dutch legalisation of euthanasia, the debate about its acceptability and boundaries is ongoing and both sides of the debate are clearly represented. (shrink)

New Perspective scholars challenge Protestant interpretations of Paul. It used to be the case, they state, that Protestants assumed that Paul was to Judaism as Luther was to Medieval Catholicism. Both men supposedly reacted against legalistic religions and championed grace-based faiths. However, in 1977, E.P. Sanders wrote Paul and Palestinian Judaism, arguing that Judaism is not a legalistic but a grace-based faith. Assuming that Sanders is correct, New Perspectivists claim that Paul’s and Luther’s theologies and experiences were thus not parallel. (...) Hence, Luther misunderstood Paul. Additionally, New Perspectivists challenge Protestant understandings of ‘justification’. In New Perspective thought, Paul uses the term ‘justification’ primarily to describe how people, particularly Gentiles, join the church Christians without following Jewish ritual laws. ‘Justification’, then, does not describe how people ‘stay in’ the covenant and receive salvation, as Protestants think. However, this article maintains that while New Perspectivists have some knowledge of Paul and Judaism, they are much less knowledgeable regarding Luther, Medieval Catholicism and Luther’s reaction to it. Greater scrutiny of these latter areas reveals large difficulties with New Perspective arguments. In addition, a review of relevant passages from Paul’s letters demonstrates that Protestants have not misunderstood Paul’s use of the term ‘justification’. Many Pauline passages show that when Paul discusses justification he is also thinking about ‘staying in’, not just ‘getting in’ the covenant. (shrink)

This article aims to apply the model of change agent to the interpretation of Colossians. Presuming a continuity between Jesus and Paul, the article introduces the concept of ‘by faith alone’ from the Pauline letters. By this expression is meant an undivided fidelity to an inclusive approach to understanding God’s work, with concrete historical roots in Jesus’ crossing of gender, ethnic and cultural boundaries. Living in this manner requires reformation, transformation and change. The study spells out in fuller detail (...) what is understood ‘by faith alone’ by discussing the meaning of ‘faith’ within its semantic domain embedded in the codes of 1st-century Mediterranean culture. To examine whether this suggestion makes sense, the author first discusses Badiou’s focus on the antidialectics of death and resurrection as well as the dialectical remnants in Badiou’s reading of Paul. The relationship between Colossians and Ephesians as a synoptic problem. Research by different scholars concluded that some letters traditionally ascribed to Paul were probably not written by him and drew a distinction between Pauline and Deutero-Pauline letters. The majority of scholars nowadays are of the opinion that the letters to the Colossians and the Ephesians are Deutero-Pauline and that Ephesians, at least, was surely not written by Paul. The results of research on the synoptic problem can be (...) used and applied to the two letters under discussion because a comparison shows that there are striking similarities between the two. The most recent research shows that Ephesians made use of the letter to the Colossians but not without redactional changes to suit the author’s literary purpose. This method is exegetically known as redaction-criticism, linked to the social-science viewpoint that the author of the letter to the Ephesians acted as a change agent on behalf of a change agency. Romans 7: 14 if. has traditionally been one of the most frequently discussed passages in the whole of the Pauline Corpus. Nevertheless, this pericope has attracted attention more because it is consistently regarded as a crucial part of Paul's theology, than because of its intrinsic exegetical problems. The main issue is whether the ‘split personality’ and the weakness of will should be regarded as essential to the life of the believing Christian; or, rather, as characteristic for those who are (...) not ‘in Christ’ and therefore beyond the power of his Spirit. For the systematic theologian, the question of whether the first person singular in these verses should be understood in an autobiographical sense is a subordinate one. However this particular question is answered, we are still confronted by the main issue. (shrink)

The just war tradition is an evolving body of tenets for determining when resorting to war is just and how war may be justly executed. Rethinking the Just War Tradition provides a timely exploration in light of new security threats that have emerged since the end of the Cold War, including ongoing conflicts in the Middle East, threats of terror attacks, and genocidal conflicts within states. The contributors are philosophers, political scientists, a U.S. Army officer, and a senior analyst at (...) the Center for Defense Information. They scrutinize some familiar themes in just war theory from fresh and original angles, and also explore altogether new territory. The last two volumes of Giorgio Agamben’s Homo Sacer series are concerned with developing a theory of use. This article offers a critical assessment of the two concepts, use and form-of-life, that form the heart of this theory: how do these two notions offer a solution to the problem of bare life that forms the core of the Homo Sacer series? First, the author describes how the original problem of bare life is taken up in The Use of Bodies and (...) how the notion of use offers an important additional characteristic of bare life. Second, inspired by Foucault’s analysis of ancient Cynicism, the author discusses in which sense the type of ‘solution’ Agamben offers to the problem of bare life might be seen as an heir to ancient Cynicism and how this interpretation clarifies his connection of form-of-life and exile. Third, the author critically assesses the different usages of use that we can find in Agamben, by comparing how Franciscan usus, Pauline chrēsis and Platonic chrēsis are taken up in his analysis. Fourth, following Foucault, the author deepens the Platonic sense of use and its relation to taking care of justice. The article concludes with a critical assessment of Agamben’s reading of Plato’s myth of Er, in which the motifs of use, exile, and care are gathered. (shrink)

In Intolerance, Polemics, and Debate in Antiquity scholars reflect on politico-cultural, philosophical, and religious forms of critical conversation in the ancient Near Eastern, Biblical, Graeco-Roman, and early-Islamic world. They enquire into the boundaries between debate, polemics, and intolerance, and address their manifestations in both philosophy and religion. This cross-cultural and inclusive approach shows that debate and polemics are not so different as often assumed, since polemics may also indicate that ultimate values are at stake. Polemics can also have a positive (...) effect, stimulating further cultural development. Intolerance is more straightforwardly negative. Religious intolerance is often a justification for politics, but also elite rationalism can become totalitarian. The volume also highlights the importance of the fluency of minorities in the dominant discourses and of their ability to develop contrapuntal lines of thought within a common cultural discourse. The prohibition against using others ‘merely as means’ is one of Kant’s most famous ideas, but it has proven difficult to spell out with precision what it requires of us in practice. In ‘How to Use Someone “Merely as a Means”’ (2020), I proposed a new interpretation of the necessary and sufficient conditions for using someone ‘merely as a means’. I argued that my agent-focused actual consent inter- pretation has strong textual support and significant advantages over other readings of the (...) prohibition. In the present essay, I respond to comments by Claudia Blöser, Irina Schumski, and Oliver Sensen. I first address the role of maxims in relation to the Formula of Humanity, and I spell out in more detail the relation between the agent’s belief and the actual facts pertaining to the consent of the person who is used as means to the agent’s end. I then discuss the importance of the requirement that agents make their use of others conditional on the others’ consent as a matter of moral principle. I next show that the proposed reading of the prohibition, despite its focus on the agent’s maxims and practical reasoning, yields important conclusions about the moral status of external actions, and I address several cases that are pur- ported to spell trouble for my reading of Kant’s prohibition. I end by outlining two challenges for possible (rational) consent readings of the prohibition against using others merely as means. (shrink)

'Autonomy' is originally a political notion. In this chapter, I argue that the political theory Kant defended while he was writing the _Groundwork_ sheds light on the difficulties that are commonly associated with his account of moral autonomy. I argue that Kant's account of the two-tiered structure of political legislation, in his _Feyerabend Lectures on Natural Law_, parallels his distinction between two levels of moral legislation, and that this helps to explain why Kant could regard the notion of 'autonomy' as (...) apt to express the principle of morality---at least in the mid 1780s. The present article will introduce a proposition of semiotic methodology that can be used to diagnose cohabitation issues in cities between human inhabitants and non-human liminals. This methodology is built on a few sets of data that should be easy to obtain in any important city, and can therefore be utilised in a variety of situations. The different sets of data allow us to map the cohabitation semiosphere (following Hoffmeyer’s meaning of the term) of the situation along three axes: the (...) materiality of the situation, the symbolic significance of the relationship, and the emotional significance of the interaction. These three aspects allow us to see gaps, paradoxes and points of consistency, enabling complex and multi-level understanding of the situation. (shrink)

Descartes, Spinoza and Leibniz stand out among their seventeenth-century contemporaries as the great rationalist philosophers. Each sought to construct a philosophical system in which theological and philosophical foundations serve to explain the physical, mental and moral universe. Through a careful analysis of their work, Pauline Phemister explores the rationalists seminal contribution to the development of modern philosophy. Broad terminological agreement and a shared appreciation of the role of reason in ethics do not mask the very significant disagreements that led (...) to three distinctive philosophical systems: Cartesian dualism, Spinozan monism and Leibnizian pluralism. The book explores the nature of, and offers reasons for, these differences. Phemister contends that Spinoza and Leibniz developed their systems in part through engagements with and amendment of Cartesian philosophy, and critically analyses the arguments and contributions of all three philosophers. The clarity of the authors discussion of their key ideas including their views on knowledge, universal languages, the nature of substance and substances, bodies, the relation of mind and body, freedom, and the role of distinct perception and reason in morals will make this book the ideal introduction to rationalist philosophy.
